Herzlich willkommen! Datensicherheit und Compliance in der Microsoft Cloud At Microsoft, we have a unique view of how technology can impact people around the world. Look around this room, in essence, we are a microcosm of our customers. We’re easily defined as professionals –business and technical people in the working world We’re passionate about the differences our business can make and the opportunities ahead But our work is not what defines us Many of us are parents Some are coaches, musicians or volunteers We read, we research, we travel, we play games, we shop and we socialize when can All aspects of our lives are important to us We expect technology to keep us connected to all of these things that we love. We also expect to have the same great technology experiences at home and at work. So, at Microsoft, we resist the temptation to do the easy thing – to do what conventional wisdom says and only build technology that is only relevant for certain people, certain aspects or their lives or for certain types of businesses. We’ve decided instead to build technology that connects billions of people around the world to who and what they love. 4 Standardisierte Erklärung zur Auftragsdaten-verarbeitung (ADV/DPA)
Ab Mitte Dezember 2011 EU Model Clauses „Office 365 ist die erste und derzeit einzige cloud basierende Produktivitätslösung, die jedem Kunden die EU Model Clauses als Standardvertragsklauseln anbietet.“ Standardisierte Erklärung zur Auftragsdaten-verarbeitung (ADV/DPA) Wir kombinieren diese Standardvertragsklauseln mit einer ebenfalls standardisierten Erklärung zur Auftragsdatenverarbeitung (Data Processing Agreement)

5 Wir sind konform mit den Empfehlungen der „Orientierungshilfe – Cloud Computing“ der Arbeitskreise Technik und Medien der Konferenz der Datenschutzbeauftragten des Bundes und der Länder www

Relevanter Vertragsinhalte) Model Clauses (Ziffer 5j, 11.4) Trust Center Technische und organisatorische Maßnahmen (TOM) Dataprocessing Agreeement (Ziffer 5a) In Model Clauses (Appendix 2) Kontrolle durch AG Vorort-Kontrollen oder Zertifizierungs/Gütesiegelverfahren einer unabhängigen Prüfstelle Model Clauses Zertifizierung nach ISO plus TOM nach § 9 BDSG (DPA Ziffer 5b) Drittstaatentransfer: angemessene Garantien, z.B. Model Clauses Dataprocessing Agreeement (Ziffer 5a) In Model Clauses (Appendix 2) Drittstaatentransfer: zusätzlich ADV-Vertrag Ergänzende Regelungen zu Model Clauses mit MSFT Corp (Appendix 1 und 2)

Erreichbar über Office365.de Homepage. Es bietet klare Informationen: wo sich die Daten eines Kunden befinden wer Zugang zu diesen Daten hat wie Microsoft diese Daten schütz welche Zertifizierungen MS erfüllt (u.a. ISO 27001, SAS 70 Type II, FISMA, Save Harbour)
