Dezember 2013 The National Centres of Competence in Research (CCR) are a research instrument of the Swiss National Science Foundation (SNSF)

Hintergrund (1) Die Gesetzgebung hinkt den neuen Technologien immer hinterher. Die Frage ist nur wie stark. In jeder Phase des Lebenszyklus der Nanomaterialien (Produktion, gewerbliche Verwendung, Konsum, Entsorgung) können positive und negative Effekte variieren. Die Anwendung von Nanomaterialien ist sehr heterogen und betrifft viele Produktekategorien.

Hintergrund (2) In den letzten Jahren wurden grosse Forschungsmittel eingesetzt, viel in Anwendungen, etwas weniger in die Sicherheitsforschung. Es bestehen Kenntnislücken bei den Langzeitwirkungen. Die OECD ist seit circa 10 Jahren daran, Teststrategien zu entwickeln und bestehende Tests für Nanomaterialien anzupassen.

Hintergrund (3) Wegen der grossen Anwendungsbreite ist eine einzige Regulierung „one size fits all“ unmöglich. Es bestehen Ansätze zu nationalen und regionalen Regulierungen im Bereich der Industriechemikalien, Biozide und Kosmetika. Es besteht (noch) kein politischer Konsens für eine Deklarationspflicht. Es bestehen grosse Regelungslücken. Das Thema Haftpflicht ist naheliegend.

Fragestellung (1) Kann man aus der Geschichte lernen (Asbest, GVOs)? Genügen die bestehende Haftpflicht-regelungen? Falls nein, welche Haftpflichtregelungen sollen vorgeschlagen werden? Auf welcher Ebene? National, regional oder global?

Fragestellung (2) Falls global Regelungen nötig sind: Bilateral oder WTO Kontext? Falls WTO Kontext geeigneter: Genügt das bestehende WTO Regime, oder braucht es etwas völlig Neues? Workshop vom 13.12.2013 beschränkt sich auf die Fragestellung (1)

Background (1) Legislation always lags back behind technology. The question is just how long. Positive and negative effects can vary in each phase of the life-cycle of nanomaterials (production, commercial use, consumption, disposal). The application of nanomaterials is very diversified and affects numerous categories of products.

Background (2) Large research funds have been invested during the last years − mainly in application, less in security. There are knowledge gaps concerning long-term effects. For about 10 years, the OECD has been developing new test strategies and adapting existing ones.

Background (3) A „one size fits all“ regulation is not possible due to the amplitutde of applications. There have been approaches made in national and regional regulations in the fields of industrial chemicals, biocides and cosmetics. There is not (yet) a political consensus on an obligation to declare. There are substantial gaps in regulation. The question of liability is obvious.

Questions (1) What can we learn from history (asbestos, gmos)? Are existing liability rules adequate? If not, what kind of liability rules could be recommended? On which level? National, regional or global?

Questions (2) If new rules are necessary: Bilateral or in the WTO context? If WTO context appears more appropriate: Is the existing WTO Regime adequate, or do we need something totally new? Todays workshop focuses on question (1)
