3 CETA: Investment CETA wäre erstes EU-FTA mit ISDS (Investor- Staat-Schiedsverfahren) Kapitel über Investitionsschutz: Referenz in TTIP-ISDS-Konsultation Aus dem Leak des CETA-Investment-Kapitels: 'investment' means: Every kind of asset that an investor owns or controls, directly or indirectly, which has the characteristics of an investment, such as the commitment of capital or other resources, the expectation of gain or profit, or the assumption of risk, and a certain duration.

4 CETA: Forms an investment may take a) an enterprise; b) shares, stocks and other forms of equity participation in an enterprise; c) bonds, debentures and other debt instruments of an enterprise; d) a loan to an enterprise; e) any other kinds of interest in an enterprise; f) an interest arising from: i. a concession conferred pursuant to domestic law or under a contract, including to search for, cultivate, extract or exploit natural resources, ii. a turnkey, construction, production, or revenue-sharing contract, or iii. other similar contracts; g) intellectual property rights; h) any other moveable property, tangible or intangible, or immovable property and related rights; i) claims to money or claims to performance under a contract;

5 CETA: Investment-Klauseln For the purposes of this definition an enterprise of a Party is: a) an enterprise that is constituted or organised under the laws of that Party and has substantial business activities in the territory of that Party; Soll Briefkästen ausschließen, aber s.b.a. nicht definiert FET: Fair and Equitable Treatment a. 6 CETA: Investment-Klauseln 4. When applying the above fair and equitable treatment obligation, a tribunal may take into account whether a Party made a specific representation to an investor to induce a covered investment, that created a legitimate expectation, and upon which the investor relied in deciding to make or maintain the covered investment, but that the Party subsequently frustrated. Legitime Erwartung haben Tribunale als Recht auf stabiles Regulierungsumfeld interpretiert (z.B. Lone Pine vs Canada).

7 CETA: Regulierungsvorbehalte non-discriminatory measures by a Party that are designed and applied to protect legitimate public welfare objectives, such as health, safety and the environment, do not constitute indirect expropriations. Where, in exceptional circumstances, capital movements and payments, including transfers, cause or threaten to cause serious difficulties for the operation of the economic and monetary union of the European Union, safeguard measures that are strictly necessary may be taken by the European Union with regard to capital movements and payments, including transfers, for a period not exceeding six months. 9 CETA: Public Procurement Zum ersten Mal haben kanadische Provinzen und Gemeinden öffentliche Beschaffung geöffnet (das war bisher weder in GPA noch NAFTA der Fall) Ontario, Quebec lockerten local content-Auflagen (stattdessen local value) u.a. im Transportsektor Befürchtungen bei Aufweichung von local content: Arbeitsplätze, Verwendung lokaler Produkte und Dienstleistungen, Steuereinnahmen, wirtschaftliche Effekte, Privilegierung lokaler Unternehmen (etwa bei Erneuerbaren Energien wie Windkraft, regionale Lebensmittel, öffentliche Dienste, Wasserwerke, Öl-, Gas-, Kohle-Förderung).
