4 3 © Haarmann Hügel Dateiname / Datum General (I) Definition –Contracts of the same type as public contracts within the meaning of the EC Procurement Directives except for the fact that –the consideration (predominantly) consits in the right to exploit what has been provided under the contract ! cf. Article 1 (d) of the Works Directive !

5 4 © Haarmann Hügel Dateiname / Datum General (II) Types –Works concessions è well-known example is a contract whereby a contracting authority grants a private company the right to exploit a motorway by charging tolls as consideration for its building (cf. Commission Interpretative Communication on Concessions under Community Law, footnote 7) –Services concessions è an example is a contract whereby a private company undertakes to publish telephone directories for the right to exploit them (cf. Case C-324/98 Telaustria [2000] ECR I- 10745)

Three types of concession contracts can be distinguish (and occur in practice) !
