Publication Article 5, in conjunction with Article 10 and Annex V of Commission “Regulation (EC) No 2074/2005 of 5 December 2005 laying down implementing measures for certain products under Regulation (EC) No 853/2004 of the European Parliament and of the Council and for the organisation of official controls under Regulation (EC) No 854/2004 of the European Parliament and of the Council and Regulation (EC) No 882/2004 of the European Parliament and of the Council, derogating from Regulation (EC) No 852/2004 of the European Parliament and of the Council and amending Regulations (EC) No 853/2004 and (EC) No 854/2004 “ stipulated that Member States were to register and publish their approved establishments in the internet, using the technical specifications provided in Annex V Chapter IV of this Regulation. Veröffentlichung Nach Artikel 5 i. V. m. Artikel 10 und Anhang V der Kommission “Verordnung (EG) Nr. 2074/2005 der Kommission vom 5. Dezember 2005 zur Festlegung von Durchführungsvorschriften für bestimmte unter die Verordnung (EG) Nr. 853/2004 des Europäischen Parlaments und des Rates fallende Erzeugnisse und für die in den Verordnungen (EG) Nr. 854/2004 des Europäischen Parlaments und des Rates und (EG) Nr. 882/2004 des Europäischen Parlaments und des Rates vorgesehenen amtlichen Kontrollen, zur Abweichung von der Verordnung (EG) Nr. 852/2004 des Europäischen Parlaments und des Rates und zur Änderung der Verordnungen (EG) Nr. 853/2004 und (EG) Nr. 854/2004“ mussten die Mitgliedstaaten ihre zugelassenen Betriebe bis zum nach der Vorgabe der technischen Spezifikation (s. Publication The Commission has issued uniform criteria for the structure of the lists, so that all Member States can easily read each other‘s lists. The criteria are specified in: TECHNICAL SPECIFICATIONS IN RELATION TO THE MASTER LIST AND THE LISTS OF EU APPROVED FOOD ESTABLISHMENTS SANCO/2179/2005 Revision 5 Veröffentlichung Damit die Listen in allen Mitgliedstaaten besser lesbar sind, hat die Kommission einheitliche Kriterien für deren Gestaltung herausgegeben. Publication The categories and contents of the Commission‘s Technical Specifications are thereby fixed, and Member States have to adhere to them when developing their lists Master list The data of all establishments approved pursuant to Regulation (EC) No. 853/2004 shall be compiled in one single master list or database. This avoids the need to maintain different lists for establishments with various kinds of approved activities. Specific lists The master list or database is the pool from which specific lists according to the Sections of Annex III of Regulation (EC) No. 853/2004 can be generated. Veröffentlichung Die Inhalte und Kategorien der Technischen Spezifikation der KOM sind damit verbindlich vorgegeben und müssen bei der Umsetzung berücksichtigt werden. Generalliste Die Daten der zugelassenen Betriebe nach der Verordnung (EG) Nr. 853/2004 sollen in einer einzigen alle Betriebe und Zulassungen umfassenden Generalliste bzw. Datenbank erfasst werden. Dadurch wird vermieden, dass Betriebe mit verschiedenen Zulassungen mit ihren Adressdaten in verschiedenen Listen erfasst und gepflegt werden müssen. Unterlisten Aus dieser Generalliste bzw. Datenbank können dann die nach der Spezifikation erforderlichen Unterlisten nach Sektionen entsprechend den Abschnitten des Anhang III der Verordnung (EG) Nr. 853/2004 generiert werden. Publication Article 31 paragraph 2 f of the Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29 April 2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules says that the competent authorities shall keep lists of approved establishments up to date and make them accessible to the public and to other Member States. Veröffentlichung Artikel 31 Absatz 2 f der Verordnung (EG) Nr. 882/2004 des Europäischen Parlaments und des Rates vom 29. April 2004 über amtliche Kontrollen zur Überprüfung der Einhaltung des Lebensmittel- und Futtermittelrechts sowie der Bestimmungen über Tiergesundheit und Tierschutz besagt, dass die zuständigen Behörden verpflichtet sind, die Listen der zugelassenen Betriebe ständig auf dem neuesten Stand zu halten und sie den übrigen Mitgliedsstaaten und der Öffentlichkeit zugänglich zu machen Federal Office of Consumer Protection and Food Safety, Unit 106, Dr. Ina More 28. Approval number - EU Legislation Regulation (EC) 854/2004 says that the competent authority shall give each approved establishment one (single) approval number, even when it is approved for various activities. Regulation (EC) 853/2004 laying down specific hygiene rules for food of animal origin contains provisions regarding the identity mark: It must be applied to the product/its packaging before the product leaves the establishment of production. It contains the manufacturing establishment‘s approval number. It contains the two-letter code of the Member State where the establishment is located („DE“ for Germany) and the abbreviation of „European Community“ in that language („EG“ in German). It must be oval in shape. EU-Recht Nach der Verordnung (EG) 854/2004 teilt die zuständige Behörde jedem zugelassenen Betrieb nur eine Zulassungsnummer zu, auch wenn er für mehrere Tätigkeiten zugelassen ist Die Verordnung (EG) 853/2004 mit spezifischen Hygienevorschriften für Lebensmittel tierischen Ursprungs enthält zudem Vorschriften zum Identitätskennzeichen: es muss vor dem Inverkehrbringen eines tierischen Erzeugnisses auf der Verpackung angebracht werden es enthält die Zulassungsnummer des Betriebs es enthält die Abkürzung des Landes, in dem sich der Betrieb befindet („DE“ für Deutschland), und die entsprechende Abkürzung für die Europäische Gemeinschaft („EG“ bei einen Betrieb aus Deutschland) es ist von ovaler Form DE Approval number EG Federal Office of Consumer Protection and Food Safety, Unit 106, Dr. Ina More 28. Approval number - National Legislation The format of approval numbers is not fixed by EU legislation, but by national legislation. Germany has made its own provisions for that in the „General Administrative Provisions in Food Hygiene“ (Allgemeine Verwaltungsvorschrift Lebensmittelhygiene): The approval number must be made up of the official abbreviation of the federal Land where the establishment resides (such as, „B“ for Berlin) and of a 5-digit number (e. g., B 12345), which is issued by the competent authority in the respective land. Approval numbers given to an establishment before the General Administrative Provisions in Food Hygiene took effect may be maintained in the old format for an indefinite period. We call these “old approval numbers”. Old approval numbers have the following characteristics: They show a code for the type of operation and a digit series of different length (e. g., EV 345, with “EV” meaning meat processing establishment). Some show a code of the federal Land, some do not. One and the same establishment may have several approval numbers, corresponding to the operational activities for which it is approved. Nationales Recht Das Format der Zulassungsnummern wird nicht durch das EU-Recht vorgegeben, sondern national festgelegt. Für Deutschland enthält die Allgemeine Verwaltungsvorschrift Lebensmittelhygiene Vorschriften hierzu: Die Zulassungsnummer muss aus den Buchstaben der amtlichen Abkürzung des Bundslandes, in dem der Betrieb gelegen ist (z. B. „B“ für Berlin) und einer 5-stelligen Nummer bestehen (z.B. B 12345), die frei vom Bundsland vergeben wird Zulassungsnummern, die vor Inkrafttreten der AVV einem Betrieb erteilt wurden, dürfen auf unbefristete Zeit in ihrem alten Format weitergeführt werden („alte Zulassungsnummern“). Alte Zulassungsnummern: enthalten ein Kürzel für die Betriebsart und eine unterschiedlich lange Nummernfolge (z. B EV 345) (EV = Verarbeitungsbetrieb für Fleischerzeugnisse), sind mit oder ohne Bundeslandkürzel versehen und ein Betrieb kann, entsprechend seiner Tätigkeiten für die er zugelassen ist, mehrere besitzen.
