Potential employment depends on current residence status: 1.Refugee is tolerated and resident in Germany already 3 months and 2.Bundesagentur für Arbeit (BFA) gives formal authorization for candidate to be allowed to work – Exception: It is possible to get work without BFA agreement – this is called: “Agreement –free employment“ Ausländerbehörde alone may approve these exceptions After 4 years, “non restrictive employment“ can be granted – Total duration = allowed status (erlaubt) + permitted (gestattet) + tolerated (geduldet) Self-employment is forbidden Note : A permitted as well as a tolerated residence contain conditions about type of employment Banned work : People from “safe home countries“ who filed asylum application can‘t work during asylum process People with “tolerated“ (geduldet) status are NOT allowed employment if : 1.Arrival is ONLY related t receive benefits from AsylbLG 2.Conditions for terminated stay can‘t be reconstructed 3.Country of origin falls within “safe countries“ RC4

6 Process Download form from rbk website – http://www.rbk-direkt.de/Dienstleistungdetail.aspx?dlid=3908 http://www.rbk-direkt.de/Dienstleistungdetail.aspx?dlid=3908 Mentor / Coach helps to fill in all relevant data for approval Mentor / Coach and refugee make an appointment with potential employer Potential employer fills in additional data in the form document and signs it Mentor / Coach sends completed form to Ausländerbehörde Ausländerbehörde works aproval process (about 4 weeks) and sends back approval Note : insurance questions have to be worked out with Sozialamt Prozess aus RBK Website 1.Antragsformular besorgen (s. unten) 2.Eine Ausbildungs-oder Arbeitsstelle finden 3.Das Antragsformular ausfüllen und vom Arbeitgeber unterschreiben lassen 4.Das Antragsformular bei der Ausländerbehörde abgeben 5.Die Entscheidung, ob gearbeitet werden darf, hängt i.d.R. von der Zustimmung der Bundesagentur für Arbeit ab und wird zusätzlich von der Ausländerbehörde getroffen. Es wird geprüft, welcher Aufenthaltsstatus vorliegt und ob länderrechtliche Bestimmungen der Ausübung einer Beschäftigung entgegenstehe 6.Frist abwarten, das Zustimmungsverfahren dauert ca. 4 Wochen, teilweise auch länger 7.Bei schriftlicher Genehmigung durch die Ausländerbehörde kann die Beschäftigung aufgenommen werden RC6

8 Conclusions - Recommendations Work as close as possible with your Mentor/Coach Arbeite so eng wie möglich mit deinem Mentor/Coach – Important to fill out required formats and documents correctly Be open and realistic about your current skills &capabilities Sei offen und realistisch über deine Kapazitäten und Fähigkeiten – Sometimes more opportunities open up during work..... Start could be slow and “below your expectations” - consider this as LEARNING Der Start könnte langsam und unter deiner Erwartung sein – betrachte es als LERNPHASE – Most likely to start an internship for a couple of weeks without payment !
